The terms that govern your use of BetterYu.

1. Acceptance of Terms

Welcome to the BetterYu website, online platform, mobile experience, and related digital services, collectively referred to as the “Site.” These Terms of Use, referred to as the “Terms,” govern your access to and use of the Site, products, services, telehealth consultation services, e-commerce features, patient intake forms, educational content, account tools, communications, and any other services offered by BetterYu, LLC and its parent company, BetterYu Holding, LLC, collectively referred to as the “Services.”

By accessing, browsing, registering for, purchasing from, or otherwise using the Site or Services, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy, Notice of Privacy Practices, Consent to Telehealth, Patient Treatment Consent and Acknowledgment of Compounded Medication Risks, Medical Disclaimer, Shipping & Returns Policy, and any additional terms presented to you at the time of purchase or service use.

If you do not agree to these Terms, you should not access or use the Site or Services.

These Terms apply to all visitors, users, customers, patients, prospective patients, account holders, and any other individuals who access or use the Site or Services.

PLEASE READ SECTION 29 (BINDING ARBITRATION AND CLASS ACTION WAIVER) CAREFULLY. IT REQUIRES YOU TO RESOLVE DISPUTES WITH BETTERYU THROUGH BINDING INDIVIDUAL ARBITRATION AND LIMITS YOUR RIGHT TO PARTICIPATE IN CLASS PROCEEDINGS. YOU HAVE A LIMITED RIGHT TO OPT OUT OF ARBITRATION AS DESCRIBED IN THAT SECTION.

2. Definitions

For purposes of these Terms:

“BetterYu,” “we,” “us,” or “our” refers collectively to BetterYu, LLC, a Wyoming limited liability company, and its parent company BetterYu Holding, LLC, a Wyoming limited liability company, including each entity’s affiliates, employees, contractors, representatives, service providers, and authorized partners.

“You,” “your,” or “User” means any person who accesses, browses, registers for, purchases from, or otherwise uses the Site or Services.

“Site” means the BetterYu website, landing pages, digital storefront, online forms, account portal, checkout pages, content pages, and any related online platform operated by or on behalf of BetterYu.

“Services” includes, but is not limited to, wellness products, related supplies, telehealth consultation coordination, provider review, customer support, educational content, prescription coordination where applicable, and related digital services.

“Products” refers to items offered through or coordinated by the Site, including compounded medications, cold packs, supplies, wellness-related products, and any other items available for purchase.

“Telehealth Services” refers to healthcare-related consultations, evaluations, provider communications, or treatment recommendations delivered remotely by licensed providers or affiliated medical professionals.

“Compounded Medication” means a prescription medication that is prepared, mixed, assembled, packaged, or labeled by a state-licensed compounding pharmacy pursuant to a valid patient-specific prescription, under Section 503A of the Federal Food, Drug, and Cosmetic Act and applicable state pharmacy law.

“Pharmacy Partner” means a state-licensed compounding pharmacy that is independent of BetterYu and that prepares and dispenses Compounded Medications pursuant to prescriptions issued by licensed providers.

“Content” includes all text, graphics, images, videos, logos, trademarks, design elements, software, code, downloadable materials, educational information, product descriptions, blog content, and other materials available through the Site.

“User Content” means any information, messages, reviews, comments, images, documents, forms, medical history, or other materials you submit to BetterYu through the Site or Services.

“PHI” means Protected Health Information as defined under the Health Insurance Portability and Accountability Act of 1996 and its implementing regulations, collectively referred to as “HIPAA.”

3. Eligibility

You must be at least 18 years old to access or use the Site or Services.

By using the Site or Services, you represent and warrant that:

  • You are at least 18 years of age;
  • You are legally capable of entering into binding agreements;
  • You will provide accurate, current, and complete information;
  • You will use the Site and Services only for lawful purposes;
  • You will comply with these Terms and all applicable laws and regulations;
  • You are not prohibited from using the Services under any applicable law.

The Services are not intended for minors. BetterYu does not knowingly market to, collect information from, or provide Services to individuals under the age of 18. In accordance with the Children’s Online Privacy Protection Act (COPPA), BetterYu does not knowingly collect personal information from children under 13.

4. Account Registration and User Responsibilities

To purchase certain products, request a consultation, access telehealth-related Services, or use certain Site features, you may be required to create an account.

When creating an account, you agree to provide accurate, complete, and current information, including your name, email address, phone number, date of birth, mailing address, billing address, health information when applicable, and any other information reasonably required to provide the Services.

You are responsible for:

  • Maintaining the confidentiality of your username, password, and login credentials;
  • All activity that occurs under your account;
  • Promptly updating your account information if it changes;
  • Providing accurate medical, health, shipping, and payment information;
  • Notifying us immediately if you suspect unauthorized access to your account.

BetterYu is not responsible for losses or damages resulting from your failure to maintain the confidentiality of your account credentials.

We reserve the right to suspend, restrict, or terminate your account if we believe your information is inaccurate, incomplete, fraudulent, unlawful, or in violation of these Terms.

5. Description of Services

BetterYu provides access to wellness-related products, educational resources, e-commerce purchasing, prescription-dependent product pathways, and telehealth-related services.

A. E-Commerce Services

Through the Site, BetterYu may offer products including, but not limited to:

  • Compounded medications dispensed in pre-filled pen injectors;
  • Refill cartridges for pen injectors;
  • Cold packs and temperature-controlled shipping materials;
  • Wellness-related supplies;
  • Related accessories or supportive products.

Certain products require a valid prescription, provider evaluation, medical intake, consultation, and clinical approval before purchase, fulfillment, or shipment.

Placement of an order does not guarantee acceptance, approval, fulfillment, prescription authorization, or shipment.

B. Telehealth Services

BetterYu coordinates access to licensed healthcare providers or affiliated medical professionals who offer online consultations, medical evaluations, prescription review, treatment recommendations, or other healthcare-related services.

Telehealth Services may include:

  • Medical intake review;
  • Health history assessment;
  • Eligibility review;
  • Provider consultation;
  • Prescription determination where clinically appropriate;
  • Follow-up communication;
  • Treatment education;
  • Pharmacy coordination.

No provider-patient relationship is established solely by browsing the Site, reading Content, completing a form, creating an account, or purchasing non-prescription products.

A provider-patient relationship is established only when a licensed provider agrees to evaluate or treat you through the appropriate clinical process.

Prior to your telehealth consultation, you will receive information regarding the licensed provider conducting your evaluation, including their name, license number, and state(s) of licensure, in accordance with applicable state law. Patients receiving telehealth services will also be provided with a separate Notice of Privacy Practices in accordance with HIPAA.

C. Prescription-Dependent Products

Some products offered through or coordinated by BetterYu may only be available with a valid prescription issued by an authorized licensed provider after appropriate clinical evaluation.

You understand and agree that:

  • Not all Users will qualify for prescription products;
  • A provider may determine that a requested product is not medically appropriate;
  • A prescription is never guaranteed;
  • Orders may be canceled if clinical approval is not granted;
  • Additional information, labs, documentation, or consultation may be required;
  • Products may be subject to federal, state, pharmacy, and medical regulations;
  • Your state of residence and the licensure status of our Pharmacy Partners in that state may affect availability.

BetterYu does not control independent clinical judgment. Licensed providers are solely responsible for medical decisions, including whether to prescribe, deny, modify, or discontinue treatment.

D. Compounded Medications Disclosure

Important Information About Compounded Medications. Many of the prescription products coordinated through BetterYu, including prescription products dispensed in pen injectors, are Compounded Medications. By using the Site or Services, you acknowledge and agree to the following:

Compounded Medications are prepared by a state-licensed compounding pharmacy pursuant to a valid, patient-specific prescription issued by a licensed healthcare provider.

Compounded Medications are NOT approved by the U.S. Food and Drug Administration (FDA). The FDA does not verify the safety, efficacy, potency, sterility, stability, or quality of compounded medications in the same manner as commercially manufactured FDA-approved drugs.

Compounded Medications may be prepared under Section 503A of the Federal Food, Drug, and Cosmetic Act and applicable state pharmacy law.

Certain active ingredients prescribed and compounded through our Pharmacy Partners are not approved by the FDA for any specific indication. Compounding of these substances is performed pursuant to applicable federal and state law and the independent clinical judgment of the prescribing provider.

Our Pharmacy Partners are separate, independent entities from BetterYu. BetterYu does not manufacture, compound, or dispense medications. BetterYu coordinates access to telehealth providers and Pharmacy Partners but is not a pharmacy.

Patient-specific compounding means there is no off-the-shelf inventory. Your medication is prepared specifically for you after your prescription is issued, which affects the timing of fulfillment, return eligibility, and refill processes.

Beyond-use dates (“BUDs”) assigned to Compounded Medications by the Pharmacy Partner are set under United States Pharmacopeia (USP) Chapter <797> standards and are typically shorter than the expiration dates of commercially manufactured drugs. You should follow the BUD and storage instructions on the pharmacy label.

Statements made about products on the Site have not been evaluated by the FDA. Compounded products are not intended to diagnose, treat, cure, or prevent any disease.

You should discuss with your provider the FDA status, risks, benefits, and alternatives to any Compounded Medication prescribed to you. Your acceptance of a prescription for a Compounded Medication will be documented through a separate Patient Treatment Consent and Acknowledgment of Compounded Medication Risks.

6. No Emergency Medical Services

BetterYu does not provide emergency medical services.

The Site and Services are not intended for medical emergencies, urgent medical conditions, or crisis situations.

IF YOU ARE EXPERIENCING A MEDICAL EMERGENCY, CALL 911 OR SEEK IMMEDIATE CARE FROM AN EMERGENCY MEDICAL PROVIDER.

Do not use the Site, customer service channels, forms, email, SMS, or telehealth messaging for emergency medical needs.

7. Medical Disclaimer

All information provided on the Site is for general educational and informational purposes only. Content on the Site is not intended to diagnose, treat, cure, prevent, or manage any disease or medical condition.

Statements made about wellness products on the Site have not been evaluated by the FDA. Compounded products are not intended to diagnose, treat, cure, or prevent any disease.

Site Content does not constitute:

  • Medical advice;
  • Diagnosis;
  • Treatment recommendation;
  • Prescription authorization;
  • Provider-patient relationship;
  • Pharmacy advice;
  • Guarantee of outcome;
  • Substitute for professional medical care.

You should always consult with a qualified healthcare provider before starting, stopping, or changing any treatment, medication, supplement, wellness product, diet, exercise program, or health-related routine.

Reliance on any information provided on the Site is solely at your own risk.

8. Telehealth Consent and Limitations

By using telehealth-related Services, you acknowledge that telehealth involves the delivery of healthcare services using electronic communications, video, audio, forms, messaging, and other remote technologies.

You understand that telehealth has potential benefits, including convenience and expanded access, but also limitations, including:

  • A provider may not be able to perform a physical examination;
  • Technology failures may interrupt communication;
  • Information you provide may be incomplete or inaccurate;
  • Certain conditions may require in-person care;
  • Telehealth may not be appropriate for all medical concerns;
  • A provider may refer you to an in-person provider or emergency care.

You agree to provide complete, accurate, and truthful information during any telehealth intake, consultation, or follow-up process.

You understand that failing to disclose relevant medical information may increase your risk of adverse effects, inappropriate treatment, or delayed care.

Your specific telehealth informed consent will be documented through a separate Consent to Telehealth provided before or at the time of your consultation.

9. Product Information and Availability

We make reasonable efforts to display accurate product descriptions, pricing, availability, ingredient information, shipping details, and related information on the Site.

However, we do not warrant that product descriptions, images, pricing, availability, or other Content is complete, accurate, current, or error-free.

Product availability may change at any time without notice and depends on, among other things, Pharmacy Partner licensure in your state, provider availability, and applicable law.

We reserve the right to:

  • Limit quantities;
  • Discontinue products;
  • Modify product offerings;
  • Correct pricing errors;
  • Cancel orders;
  • Refuse service;
  • Substitute packaging when appropriate;
  • Delay shipment due to pharmacy, fulfillment, regulatory, weather, or logistical issues.

Product images are for illustrative purposes only and may not exactly reflect the product received.

10. Purchases, Payments, and Order Acceptance

A. Order Placement

When you place an order through the Site, you agree that all information you provide is accurate, complete, and authorized.

Your receipt of an order confirmation does not mean that your order has been accepted, clinically approved, prescribed, fulfilled, or shipped.

We reserve the right to accept, reject, cancel, or modify orders for any reason, including:

  • Product unavailability;
  • Prescription denial;
  • Provider determination;
  • Payment failure;
  • Suspected fraud;
  • Incorrect pricing;
  • Shipping restrictions;
  • Regulatory limitations or Pharmacy Partner state licensure restrictions;
  • Incomplete or inaccurate information;
  • Violation of these Terms.

B. Pricing and Payment

Prices are listed on the Site and may change without notice.

By submitting payment information, you represent and warrant that:

  • You are authorized to use the payment method;
  • The payment information is accurate;
  • You authorize BetterYu or its payment processor to charge the full amount of your purchase;
  • You are responsible for applicable taxes, shipping costs, and fees.

Payments may be processed by third-party payment processors. BetterYu is not responsible for the independent privacy, security, or processing practices of those third parties.

C. Billing Errors

If we discover a billing, pricing, or payment error, we reserve the right to correct it, cancel the order, request additional payment, issue a refund, or otherwise resolve the issue in a commercially reasonable manner.

You agree to promptly notify us if you believe there is an error with your order or payment.

11. Shipping, Delivery, and Fulfillment

Shipping timelines, costs, carriers, tracking, packaging, and delivery procedures may vary based on product type, prescription status, pharmacy processing, weather conditions, carrier performance, destination, and applicable law.

Compounded Medications are shipped directly from the Pharmacy Partner. Some products require temperature-controlled packaging, cold packs, or expedited shipping.

You are responsible for providing an accurate shipping address and ensuring that you are available to receive time-sensitive or temperature-sensitive deliveries. You should refrigerate Compounded Medications promptly upon receipt according to the pharmacy label.

BetterYu is not responsible for delays, failed deliveries, theft, damage, or product compromise caused by:

  • Incorrect shipping information;
  • Missed delivery attempts;
  • Carrier delays;
  • Weather events;
  • Natural disasters;
  • Refusal of delivery;
  • Failure to retrieve package promptly;
  • State or regulatory restrictions;
  • Events outside our reasonable control.

12. Returns, Refunds, and Cancellations

Due to the nature of Compounded Medications, prescription products, temperature-sensitive products, injectable products, and safety requirements, certain products are final sale and not eligible for return once dispensed, shipped, opened, or fulfilled. Federal and state pharmacy law generally prohibits the return and redispensing of compounded medications.

Refunds, replacements, or credits may be considered in accordance with our Shipping & Returns Policy and applicable law.

We reserve the right to deny refunds, returns, replacements, or cancellations where:

  • A product has already been dispensed or shipped;
  • The product is prescription-based or a Compounded Medication;
  • The product is temperature-sensitive;
  • The request falls outside the stated policy window;
  • The issue results from incorrect information provided by you;
  • There is evidence of misuse, tampering, fraud, or policy abuse.

Clinical consultation fees, provider review fees, administrative fees, and shipping fees may be non-refundable unless otherwise required by law or expressly stated in writing.

13. Subscriptions, Refills, and Recurring Orders

If BetterYu offers subscriptions, refill programs, recurring billing, or automatic shipments, additional terms apply.

Enrollment in a subscription or recurring order program requires your separate, affirmative consent at the time of enrollment, distinct from your acceptance of these Terms. Before you are enrolled, BetterYu will clearly and conspicuously disclose the recurring nature of the charges, the frequency, the amount, and how to cancel.

By enrolling in a subscription or recurring order program, you authorize BetterYu or its payment processor to charge your selected payment method on a recurring basis until canceled.

You are responsible for:

  • Maintaining accurate payment information;
  • Updating shipping information;
  • Monitoring renewal dates;
  • Canceling before the applicable deadline;
  • Completing any required provider review or refill authorization.

You may cancel your subscription at any time online through your account portal, by email to info@thebetteryu.com, or by any other method we make available. We do not require a phone call to cancel. We will provide renewal reminders prior to each recurring charge in accordance with applicable law, including the federal Restore Online Shoppers’ Confidence Act (ROSCA) and applicable state automatic renewal laws.

Prescription refills are subject to provider approval and are not guaranteed.

BetterYu may pause, cancel, or modify recurring orders if clinical approval is not obtained, payment fails, products are unavailable, or legal requirements change.

14. User Conduct

You agree not to use the Site or Services for any unlawful, harmful, fraudulent, abusive, or unauthorized purpose.

You agree that you will not:

  • Violate any applicable law or regulation;
  • Submit false, misleading, incomplete, or fraudulent information;
  • Misrepresent your identity, age, medical history, or eligibility;
  • Attempt to obtain products for resale, diversion, or unauthorized use;
  • Purchase products on behalf of another person without authorization;
  • Use another person’s account or payment method without permission;
  • Interfere with Site security or functionality;
  • Upload viruses, malware, or harmful code;
  • Attempt to hack, reverse engineer, scrape, crawl, or disrupt the Site;
  • Infringe the intellectual property or privacy rights of others;
  • Harass, threaten, abuse, or defame BetterYu, its providers, staff, partners, or other users;
  • Use the Site to transmit spam, unsolicited messages, or unlawful content;
  • Attempt to bypass prescription, age, identity, or eligibility requirements.

Violation of this section may result in suspension or termination of your account, cancellation of orders, denial of Services, and potential legal action.

15. User Content and Information You Submit

You may submit information through the Site, including account details, intake forms, medical history, messages, reviews, images, documents, or other materials.

By submitting User Content, you represent and warrant that:

  • The information is accurate and complete;
  • You have the right to submit it;
  • It does not violate any law or third-party rights;
  • It is not false, defamatory, abusive, obscene, or harmful.

You grant BetterYu the right to use User Content as reasonably necessary to provide, operate, improve, and administer the Services, subject to our Privacy Policy and applicable health privacy laws.

Medical and health-related information will be handled in accordance with applicable privacy laws, including HIPAA where applicable.

16. Privacy

Your use of the Site and Services is also governed by our Privacy Policy and, where applicable, our Notice of Privacy Practices under HIPAA.

By using the Site or Services, you acknowledge that BetterYu may collect, use, store, disclose, and protect your information as described in those documents.

Certain health information may be subject to additional protections under HIPAA and applicable state health privacy laws.

You are responsible for reviewing the Privacy Policy and the Notice of Privacy Practices before using the Site or Services.

17. Intellectual Property

All Content on the Site is owned by BetterYu, its licensors, partners, or content providers and is protected by copyright, trademark, trade dress, patent, trade secret, and other intellectual property laws.

This includes, but is not limited to:

  • Text;
  • Graphics;
  • Images;
  • Logos;
  • Product names;
  • Brand names;
  • Website design;
  • Videos;
  • Software;
  • Code;
  • Educational materials;
  • Protocols;
  • Downloadable resources;
  • Marketing copy;
  • Service descriptions;
  • Visual assets.

You may access and use the Site and Content for personal, non-commercial purposes only.

You may not, without prior written permission:

  • Copy, reproduce, distribute, or modify Site Content;
  • Create derivative works;
  • Use BetterYu trademarks or logos;
  • Resell or commercially exploit Content;
  • Scrape, harvest, or extract Content;
  • Use Content for competing business purposes;
  • Remove copyright, trademark, or proprietary notices.

All rights not expressly granted are reserved by BetterYu.

18. Limited License to Use the Site

Subject to your compliance with these Terms, BetterYu grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Site for your personal, lawful, non-commercial use.

This license does not include any right to:

  • Modify the Site;
  • Use the Site for resale or commercial exploitation;
  • Access source code;
  • Use automated tools to extract data;
  • Interfere with Site operations;
  • Use the Site in violation of law or these Terms.

We may revoke this license at any time.

19. Third-Party Services and Links

The Site may link to or integrate with third-party services, including:

  • Payment processors;
  • Telehealth platforms;
  • Pharmacy Partners;
  • Laboratories;
  • Shipping carriers;
  • Analytics tools;
  • Marketing platforms;
  • Social media platforms;
  • External websites.

BetterYu does not control and is not responsible for third-party websites, services, content, terms, privacy policies, security practices, or actions.

Your use of third-party services is governed by their own terms and privacy policies.

Links to third-party websites do not imply endorsement or responsibility by BetterYu.

20. No Guarantees of Results

BetterYu does not guarantee any specific health, wellness, aesthetic, performance, weight loss, recovery, sleep, anti-aging, or other outcome from use of the Site, Services, telehealth consultations, products, educational Content, or provider recommendations.

Individual results may vary based on many factors, including:

  • Age;
  • Health history;
  • Lifestyle;
  • Medical conditions;
  • Medication use;
  • Consistency;
  • Genetics;
  • Diet and exercise;
  • Provider recommendations;
  • Product use;
  • Other individual factors.

Testimonials, reviews, case studies, or examples are not guarantees of results.

21. Assumption of Risk and Adverse Event Reporting

You acknowledge that wellness products, prescription products, injectable products, Compounded Medications, medications, supplements, and telehealth-related services may involve risks.

Potential risks may include, but are not limited to:

  • Side effects;
  • Allergic reactions;
  • Injection site reactions;
  • Medication interactions;
  • Contraindications;
  • Improper use;
  • Storage or temperature issues;
  • Delayed care if telehealth is not appropriate;
  • Unexpected or undesired outcomes;
  • Risks associated with non-FDA-approved compounded medications.

You agree to follow all provider instructions, product instructions, prescription directions, storage requirements, and safety guidance.

You should promptly contact a healthcare provider if you experience concerning symptoms or adverse effects. You also agree to promptly report any adverse events, side effects, or product quality concerns to BetterYu at info@thebetteryu.com. BetterYu may be required to report certain adverse events or product complaints to regulatory authorities, Pharmacy Partners, or providers.

22. Disclaimers

The Site, Services, Content, and products are provided on an “AS IS” and “AS AVAILABLE” basis, except as otherwise expressly required by law.

To the fullest extent permitted by law, BetterYu disclaims all warranties, express or implied, including but not limited to:

  • Implied warranties of merchantability;
  • Fitness for a particular purpose;
  • Non-infringement;
  • Accuracy;
  • Completeness;
  • Reliability;
  • Availability;
  • Security;
  • Error-free operation;
  • Uninterrupted access;
  • Product availability;
  • Clinical eligibility;
  • Treatment outcomes.

We do not warrant that the Site will be uninterrupted, secure, timely, error-free, free of viruses, or available at all times.

23. Limitation of Liability

To the maximum extent permitted by law, BetterYu, its affiliates, owners, officers, employees, contractors, providers, vendors, partners, licensors, and representatives shall not be liable for any indirect, incidental, consequential, special, exemplary, punitive, or enhanced damages arising out of or related to your use of the Site, Services, products, Content, or these Terms.

This includes, but is not limited to, damages for:

  • Loss of profits;
  • Loss of data;
  • Loss of goodwill;
  • Business interruption;
  • Personal injury, except where liability cannot be limited by law;
  • Product misuse;
  • Shipping delays;
  • Unauthorized account access;
  • Technology failures;
  • Third-party actions, including actions of Pharmacy Partners and independent providers;
  • Inability to access Services;
  • Reliance on Site Content.

To the fullest extent permitted by law, BetterYu’s total aggregate liability for any claim arising from or relating to the Site, Services, products, or these Terms shall not exceed the greater of (a) the amount you paid to BetterYu for the specific product or service giving rise to the claim during the twelve (12) months preceding the event giving rise to liability, or (b) five hundred dollars ($500).

Some jurisdictions do not allow certain limitations of liability, so some limitations may not apply to you. Nothing in these Terms limits liability for gross negligence, willful misconduct, fraud, or any other liability that cannot be limited under applicable law.

24. Indemnification

You agree to defend, indemnify, and hold harmless BetterYu, its affiliates, owners, officers, employees, contractors, providers, vendors, partners, licensors, and representatives from and against any claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys’ fees, arising from or relating to:

  • Your use or misuse of the Site or Services;
  • Your violation of these Terms;
  • Your violation of any law or regulation;
  • Your violation of third-party rights;
  • Your submission of false, incomplete, or misleading information;
  • Your misuse of products;
  • Your failure to follow provider instructions;
  • Your User Content;
  • Unauthorized use of your account;
  • Your negligent, fraudulent, or wrongful conduct.

We reserve the right to assume exclusive defense and control of any matter subject to indemnification, and you agree to cooperate with our defense.

25. Suspension and Termination

We may suspend, restrict, or terminate your access to the Site, Services, or account at any time, with or without notice, if we believe:

  • You violated these Terms;
  • You provided false or misleading information;
  • Your account has been compromised;
  • You engaged in fraudulent, unlawful, or abusive behavior;
  • You attempted to obtain products improperly;
  • You created risk for BetterYu, providers, Pharmacy Partners, vendors, or other users;
  • Your use of the Services violates applicable law or regulatory requirements.

Upon termination, your right to access or use the Site and Services will immediately cease.

Sections of these Terms that by their nature should survive termination will survive, including intellectual property, disclaimers, limitation of liability, indemnification, governing law, dispute resolution, arbitration, class action waiver, and any payment obligations.

26. Compliance With Laws and State Availability

You agree to comply with all applicable federal, state, local, and international laws and regulations when using the Site or Services.

BetterYu’s Pharmacy Partners are licensed in specific states. Your eligibility to receive products depends on whether the Pharmacy Partner network is licensed in your state of residence, on provider availability in your state, on telehealth regulations applicable to your state, and on applicable law.

Orders will not be fulfilled to states where Pharmacy Partner licensure, provider licensure, or applicable law prohibits shipment or service.

BetterYu reserves the right to limit, deny, or cancel access to products or Services where required by law or where we determine that fulfillment is not permitted or appropriate.

27. Force Majeure

BetterYu shall not be liable for delays, failures, or inability to perform caused by events beyond our reasonable control, including:

  • Acts of God;
  • Natural disasters;
  • Severe weather;
  • Carrier delays;
  • Supply chain disruptions;
  • Labor disputes;
  • Power outages;
  • Internet or telecommunications failures;
  • Cyberattacks;
  • Government actions;
  • Public health emergencies;
  • War, terrorism, or civil unrest;
  • Pharmacy or vendor delays;
  • Regulatory changes.

28. Governing Law

These Terms and any dispute arising out of or relating to these Terms, the Site, Services, products, or your relationship with BetterYu shall be governed by the laws of the State of Wyoming, without regard to conflict of law principles, except where the consumer protection or healthcare laws of the User’s state of residence provide non-waivable rights, in which case those rights apply.

29. Dispute Resolution, Binding Arbitration, and Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND TO HAVE A JURY TRIAL.

A. Informal Dispute Resolution

Before filing any claim, you agree to first contact BetterYu at info@thebetteryu.com and provide a written description of the dispute, the relief requested, and any supporting documentation. The parties agree to make a good-faith effort to resolve the dispute informally for at least sixty (60) days before initiating arbitration or court proceedings.

B. Binding Arbitration

Except for claims described in Section 29(D) below, you and BetterYu agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Site, Services, products, or your relationship with BetterYu shall be resolved exclusively through final and binding individual arbitration, rather than in court.

The arbitration shall be administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules, as modified by these Terms. The arbitration will be conducted by a single neutral arbitrator. The seat of arbitration shall be Sheridan, Wyoming, but you may elect to participate by telephone or video, or in person in your home county if you prefer.

The arbitrator has exclusive authority to resolve any dispute relating to the interpretation, applicability, enforceability, or formation of this arbitration agreement, including any claim that all or any part of it is void or voidable.

The Federal Arbitration Act governs the interpretation and enforcement of this arbitration agreement.

Judgment on the arbitration award may be entered in any court of competent jurisdiction.

C. Class Action Waiver

YOU AND BETTERYU AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, PRIVATE ATTORNEY GENERAL, OR REPRESENTATIVE PROCEEDING.

The arbitrator may not consolidate more than one person’s claims and may not preside over any form of class or representative proceeding. If a court or arbitrator decides that this class action waiver is unenforceable as to any claim, then that claim (and only that claim) shall be severed from arbitration and brought in court, while all other claims continue in arbitration.

D. Exceptions to Arbitration

Notwithstanding the foregoing, the following claims are not subject to arbitration:

  • Small claims court actions brought on an individual basis, where the small claims court has jurisdiction;
  • Claims seeking injunctive or other equitable relief for alleged infringement or misappropriation of intellectual property;
  • Any claim that cannot be required to be arbitrated as a matter of law.

E. Right to Opt Out of Arbitration

You have the right to opt out of this arbitration agreement and class action waiver. To opt out, you must send written notice of your decision to opt out to BetterYu at info@thebetteryu.com, with the subject line “Arbitration Opt-Out,” within thirty (30) days of the date you first accept these Terms. Your opt-out notice must include your full name, mailing address, email address, and a clear statement that you wish to opt out of the arbitration agreement. If you opt out, neither you nor BetterYu can require the other to participate in arbitration. Opting out has no effect on any other provision of these Terms.

F. Venue for Non-Arbitrable Claims

For any claim not subject to arbitration, including claims by Users who validly opt out under Section 29(E), the parties agree that such claims shall be brought exclusively in the state or federal courts located in Sheridan County, Wyoming, and the parties consent to the personal jurisdiction and venue of those courts, except where prohibited by applicable law.

G. Survival and Severability

This Section 29 survives termination of these Terms. If any portion of this Section 29 (other than the class action waiver) is found unenforceable, the remainder shall continue to apply. If the class action waiver is found unenforceable as to a particular claim, the consequences described in Section 29(C) apply.

30. Electronic Communications

By using the Site or Services, you consent to receive electronic communications from BetterYu, including emails, SMS messages, account notices, order updates, service notices, telehealth-related communications, legal notices, and marketing communications where permitted.

You agree that electronic communications satisfy any legal requirement that such communications be in writing.

You may opt out of marketing communications as described in our Privacy Policy, but you may still receive transactional, legal, healthcare-related, or service-related communications.

31. SMS and Messaging Terms

If you provide your mobile phone number and opt in to receive SMS messages through a separate, affirmative consent checkbox at sign-up or checkout, you consent to receive text messages from BetterYu, which may include order updates, appointment reminders, account notices, customer support communications, and promotional messages where permitted.

By providing your mobile number and checking the SMS consent box during account creation, checkout, or any other point of collection, you provide your prior express written consent under the Telephone Consumer Protection Act (TCPA) to receive autodialed marketing and informational messages from BetterYu at the number provided. Consent is not a condition of purchase.

Message frequency varies. Message and data rates may apply. Reply HELP for help. Reply STOP to opt out of marketing SMS messages.

Opting out of marketing SMS does not necessarily opt you out of transactional or healthcare-related messages where permitted by law.

BetterYu is not responsible for delayed or undelivered messages.

32. Accessibility

BetterYu is committed to making the Site accessible to all users, including users with disabilities, consistent with applicable law. If you have difficulty accessing any portion of the Site, or if you would like to request an accommodation, please contact us at info@thebetteryu.com and we will work in good faith to address your request.

33. Modifications to the Site or Services

We reserve the right to modify, suspend, discontinue, or restrict any part of the Site or Services at any time, with or without notice.

This includes the right to change:

  • Product offerings;
  • Pricing;
  • Service availability;
  • Telehealth access;
  • Provider availability;
  • Content;
  • Site functionality;
  • Account features;
  • Shipping options;
  • Subscription terms.

We are not liable to you or any third party for modifications, suspension, or discontinuation of any Site feature, product, or Service.

34. Modification of Terms

We may update or revise these Terms at any time.

When we update the Terms, we will revise the “Last Updated” date at the top of the document. We may also provide notice by email, account notification, Site posting, or other reasonable means if changes are material.

Your continued use of the Site or Services after updated Terms are posted constitutes your acceptance of the revised Terms. Material changes to the arbitration provision in Section 29 will not apply to disputes for which the parties have actual notice on or before the date of change unless you affirmatively accept the change.

If you do not agree to the updated Terms, you should stop using the Site and Services.

35. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in full force and effect.

36. Waiver

No failure or delay by BetterYu in exercising any right, remedy, power, or privilege under these Terms shall operate as a waiver.

Any waiver must be in writing and signed by an authorized representative of BetterYu.

37. Assignment

You may not assign, transfer, or delegate these Terms or your rights or obligations under these Terms without our prior written consent.

BetterYu may assign, transfer, or delegate these Terms, in whole or in part, without restriction, including in connection with a merger, acquisition, reorganization, sale of assets, or business transfer.

38. Entire Agreement

These Terms, together with the Privacy Policy, Notice of Privacy Practices, Consent to Telehealth, Patient Treatment Consent and Acknowledgment of Compounded Medication Risks, Medical Disclaimer, Shipping & Returns Policy, and any additional policies or agreements referenced herein, constitute the entire agreement between you and BetterYu regarding your use of the Site and Services.

These Terms supersede any prior or contemporaneous agreements, communications, or understandings related to the Site or Services.
