Terms & Conditions
The terms that govern BetterYu’s website, products, and services.
Last Updated: May 27, 2026
These Terms and Conditions (“Terms”) govern your access to and use of the BetterYu website, online intake forms, checkout pages, patient portal links, communications, educational content, and related online services made available by BetterYu (“BetterYu,” “we,” “us,” or “our”).
By accessing or using the BetterYu website, submitting information through our online intake process, creating an account, completing a purchase, or using any BetterYu-related online service, you agree to these Terms. If you do not agree to these Terms, you should not use the website, submit information through BetterYu, or purchase any BetterYu product or service.
These Terms are intended to supplement, not replace, any informed consent forms, telehealth consent forms, privacy notices, payment terms, prescription disclosures, pharmacy disclosures, patient portal terms, provider-specific documents, or other service-specific documents that may apply to your care, order, or purchase.
1. Website Purpose
The BetterYu website is intended to provide general information about wellness services, prescription wellness offerings, provider-led care pathways, and related products or services.
The website may allow individuals to begin an intake process, learn about available wellness options, request additional information, access a third-party patient portal, complete forms, make payments, communicate with BetterYu or affiliated service providers, and purchase eligible products or services.
The website itself does not provide medical consultations, medical diagnosis, medical treatment, or emergency medical services. Medical services, when available, are provided only by appropriately licensed healthcare professionals who determine whether an individual is eligible for evaluation, treatment, prescription products, follow-up care, or other services.
Nothing on the website guarantees that you will qualify for any product, service, prescription, treatment, refill, program, or wellness offering.
2. No Medical Advice on Website
All content on the BetterYu website is provided for general informational and educational purposes only. Website content is not medical advice, is not a diagnosis, and is not a substitute for consultation with a licensed healthcare provider.
You should not rely on website content to make health-related decisions. You should consult a qualified healthcare provider regarding any medical question, medication, treatment, product, or wellness service.
If you are experiencing a medical emergency, call 911 or seek immediate emergency medical attention. BetterYu is not an emergency medical provider and does not provide urgent or emergency care through the website.
3. Eligibility
By using the website, submitting an intake request, creating an account, or completing a purchase, you represent that:
- You are at least 18 years old;
- You are located in a jurisdiction where BetterYu or affiliated providers are permitted to offer services;
- The information you provide is accurate, complete, and current;
- You are using the website for yourself or for a person for whom you are legally authorized to act;
- You will not submit false, misleading, incomplete, or fraudulent information;
- You will promptly update any information that changes, including contact information, shipping information, payment information, relevant health information, medication use, provider instructions, and other information needed to evaluate or fulfill your request.
BetterYu reserves the right to decline, suspend, or terminate access to the website, services, intake process, checkout, account, or related offerings if we believe you are ineligible, have provided inaccurate information, have misused the website, have violated these Terms, or if services are not available in your location.
4. Intake Requests, Consultation Type, and Patient Portal
Submitting an intake request through the BetterYu website does not automatically create a healthcare provider-patient relationship.
A healthcare provider-patient relationship is formed only when an appropriately licensed provider accepts responsibility for evaluating or treating you, and only within the scope of that provider’s professional relationship with you.
After submitting an intake request, you may be directed to a patient portal or other third-party technology platform to complete additional forms, provide information, upload documentation, communicate with providers, review consents, receive instructions, or complete other required steps.
Before any consultation or provider evaluation occurs, BetterYu or its affiliated provider network will determine, based on your state of residence, location at the time of service, applicable law, provider licensing requirements, and clinical requirements, whether the consultation or provider evaluation may be conducted synchronously, asynchronously, or through another legally permitted care pathway.
Synchronous consultations may include real-time audio, video, phone, or other live communication methods where required or appropriate. Asynchronous consultations may include intake forms, history review, portal messaging, uploaded documentation, questionnaires, or other store-and-forward communications where permitted by applicable law.
Your failure to complete required forms, provide accurate information, respond to requests, complete required steps, or follow instructions may delay or prevent evaluation, treatment, prescription approval, shipment, refill authorization, or continued service.
5. Telehealth and Provider Evaluation Services
Some BetterYu services may involve telehealth, remote intake, electronic communications, virtual consultation, synchronous consultation, asynchronous provider review, portal messaging, remote care coordination, or other technology-enabled services.
The type of consultation or provider evaluation available to you will be determined before consultation based on your state, your location at the time of service, applicable federal and state law, provider licensing requirements, clinical requirements, and the nature of the requested product or service.
Where required by applicable law or provider judgment, a synchronous consultation may be required before approval, prescribing, refill authorization, or continued service. Where permitted by applicable law, an asynchronous provider evaluation may be used, which may include review of intake responses, submitted information, uploaded documentation, prior records, portal communications, questionnaires, or other submitted materials.
Telehealth may not be appropriate for every person, product, service, or situation. By participating in telehealth, remote intake, or provider evaluation, you understand that:
- BetterYu or its affiliated provider network will determine the legally permitted consultation pathway before consultation;
- A consultation or provider evaluation may be synchronous or asynchronous depending on state law and applicable requirements;
- A provider may rely on information you submit electronically where permitted by law;
- A provider may require additional information, documentation, consultation, records, testing, or in-person evaluation;
- Telehealth and remote evaluation have limitations compared with in-person care;
- Technical issues may interrupt or delay communication;
- Not all services are available in all states;
- Providers may decline to prescribe, treat, refill, or continue care when not appropriate;
- Prescriptions are issued only when medically appropriate and legally permitted.
Prescription decisions are made solely by licensed providers exercising independent clinical judgment. BetterYu does not guarantee that any prescription, product, dose, formulation, refill, shipment, or service will be approved or provided.
6. Prescription Products and Wellness Offerings
BetterYu may provide access to licensed healthcare providers who evaluate individuals for wellness-focused products, services, and prescription offerings, depending on eligibility, legal availability, and provider judgment.
Before any prescription product or wellness offering is approved, BetterYu or its affiliated provider network will determine whether applicable law requires a synchronous consultation, permits an asynchronous evaluation, or requires another legally compliant care pathway.
Prescription decisions are made solely by licensed healthcare providers. BetterYu does not guarantee that any product, prescription, service, refill, dosage, formulation, schedule, or delivery method will be recommended, approved, prescribed, dispensed, shipped, or continued.
Your provider may determine that a product or service is not appropriate for you based on information submitted, provider judgment, safety considerations, legal requirements, availability, pharmacy requirements, or other relevant factors.
You agree that you will use any prescribed product only as directed and will not share, sell, transfer, redistribute, alter, misuse, or use any product in a manner inconsistent with provider instructions, labeling, or applicable law.
7. Pharmacy Fulfillment and Product Availability
Some products, if approved by a licensed provider and legally permitted, may be fulfilled by third-party pharmacies or other authorized fulfillment partners. BetterYu does not manufacture prescription products and may rely on independent third parties for dispensing, fulfillment, packaging, and shipment.
Product availability may change at any time due to legal requirements, pharmacy policies, supply availability, provider judgment, shipping limitations, regulatory updates, operational issues, or other circumstances.
BetterYu does not guarantee the availability of any specific product, dose, formulation, pharmacy, fulfillment partner, refill, shipment date, or delivery timeline.
8. No Guarantee of Results
BetterYu does not guarantee any specific outcome, result, improvement, change, benefit, experience, or response from any product, service, program, or wellness offering.
Individual outcomes vary based on many factors, including personal history, provider recommendations, adherence, lifestyle, product tolerance, individual response, follow-up completion, and other factors outside BetterYu’s control.
Any testimonials, reviews, examples, descriptions, or individual experiences displayed on the website are individual experiences and do not guarantee that you will experience the same or similar results.
9. Educational Content and Marketing Claims
BetterYu strives to present website content, service descriptions, product information, FAQs, and marketing materials responsibly.
All website content is intended for general informational purposes only. Nothing on the website is intended to claim that any product or service diagnoses, treats, cures, mitigates, or prevents any disease unless expressly permitted by law and supported by appropriate substantiation.
BetterYu may update, modify, remove, or revise website content at any time.
10. Patient and Customer Responsibility
You are responsible for providing accurate, complete, and current information throughout the intake, checkout, provider review, payment, fulfillment, and follow-up process.
You agree to promptly notify BetterYu or the appropriate provider of any relevant change that could affect your eligibility, safety, payment, shipping, product use, or ongoing service.
You are responsible for reviewing all instructions, product information, order details, shipping information, payment details, and provider guidance before completing a purchase or using any product or service.
You should not start, stop, change, combine, or misuse any product or service without consulting an appropriate healthcare provider.
11. Required Follow-Up and Monitoring
Certain services may require follow-up, documentation, testing, reassessment, provider communication, or other ongoing requirements.
Follow-up requirements may be synchronous or asynchronous depending on your state, applicable law, provider licensing requirements, clinical requirements, and provider judgment.
If follow-up or additional steps are required, service may be delayed, modified, paused, or discontinued if those requirements are not completed.
BetterYu and affiliated providers may decline to approve, refill, continue, or ship any product or service if required steps are incomplete, if information is missing, if payment is not complete, if a provider determines continued use is not appropriate, or if legal or operational requirements prevent fulfillment.
12. Third-Party Providers, Pharmacies, Platforms, and Service Partners
BetterYu may coordinate with or link to third-party healthcare providers, pharmacies, laboratories, software platforms, payment processors, scheduling tools, patient portals, messaging platforms, shipping carriers, or other service providers.
These third parties may have their own terms, privacy policies, consent forms, payment policies, refund policies, shipping policies, pharmacy policies, and user responsibilities.
BetterYu is not responsible for third-party systems, policies, delays, errors, outages, fulfillment decisions, provider decisions, pharmacy decisions, carrier actions, or other third-party acts or omissions, except as required by applicable law.
Use of a third-party patient portal, pharmacy, payment processor, laboratory, fulfillment service, or shipping carrier may be subject to separate terms and conditions.
13. Account Security
If you create an account, access a patient portal, or receive login credentials, you are responsible for maintaining the confidentiality of your username, password, and account information.
You agree not to share your login credentials with anyone else. You are responsible for all activity that occurs through your account unless unauthorized activity results from BetterYu’s failure to meet its legal obligations.
You agree to notify BetterYu promptly if you believe your account has been accessed without authorization.
14. Payments, Fees, and Billing
By purchasing products or services, submitting payment information, authorizing a transaction, enrolling in a program, or placing an order, you agree to pay all applicable fees, charges, taxes, shipping costs, service fees, consultation fees, product costs, program fees, subscription fees, refill fees, administrative fees, or other amounts disclosed at the time of purchase or enrollment.
Payment may be collected by BetterYu or by a third-party payment processor. You authorize BetterYu and its payment processors to charge your selected payment method for amounts due.
Unless otherwise stated in writing, fees may not include third-party costs, follow-up services, shipping upgrades, additional documentation, or other separately disclosed charges.
BetterYu reserves the right to change pricing, packages, fees, product availability, service availability, and program details at any time. Pricing changes will not affect completed charges, but may apply to future orders, refills, renewals, subscriptions, or services.
15. Subscription, Refill, and Recurring Payment Terms
Some products or services may be offered as subscriptions, membership plans, recurring refill programs, or recurring payment arrangements. If you enroll in a recurring program, you authorize recurring charges to your payment method according to the terms disclosed at enrollment.
Recurring refills, shipments, or services are not guaranteed. Each refill, shipment, or service may remain subject to provider approval, eligibility, legal requirements, product availability, pharmacy requirements, payment status, and completion of required steps.
Refill review, continued service review, or renewal evaluation may require synchronous or asynchronous provider interaction depending on your state, applicable law, provider licensing requirements, clinical requirements, and provider judgment.
You may cancel a subscription or recurring program according to the cancellation instructions provided at enrollment, in your account, or by contacting BetterYu.
Cancellation requests may not stop charges, orders, provider review, pharmacy processing, fulfillment, or shipments that have already been submitted, processed, approved, or transferred to a third party before the cancellation request is received and applied.
BetterYu may pause, cancel, restrict, or modify a subscription, refill program, or recurring service if required by law, provider judgment, product availability, payment status, incomplete documentation, safety considerations, operational limitations, or business necessity.
16. Terms of Sale and No Refund Policy
All purchases made through BetterYu are final.
Due to the nature of prescription products, provider review, administrative processing, pharmacy fulfillment, and personalized service coordination, BetterYu does not offer refunds, returns, cancellations, modifications, or exchanges once an order has been placed and processed.
By completing a purchase, you acknowledge and agree that:
- All sales are final and non-refundable;
- Orders cannot be canceled, modified, returned, exchanged, or refunded once submitted and processed;
- You are responsible for reviewing all order details before purchase;
- You are responsible for confirming that your contact information, shipping address, payment information, and selected order details are accurate before submitting an order;
- Fees may be incurred for provider review, administrative processing, pharmacy processing, fulfillment, payment processing, shipping, and related services;
- Prescription products and other regulated items generally cannot be returned, reused, resold, or restocked after processing, dispensing, or shipment;
- Failure to complete required intake steps, respond to requests, provide accurate information, or meet eligibility requirements does not guarantee a refund;
- BetterYu may decline, pause, or cancel an order where legally required, clinically necessary, operationally necessary, or otherwise appropriate.
If an order cannot be fulfilled due to product availability, legal restrictions, provider decision, pharmacy determination, payment failure, missing information, or other circumstances, BetterYu may determine, in its sole discretion and where permitted by law, whether a replacement, credit, cancellation, partial adjustment, or other resolution is appropriate.
Nothing in this policy limits any rights you may have under applicable law.
17. Damaged or Incorrect Orders
If you receive a damaged or incorrect item, you must contact BetterYu within 48 hours of confirmed delivery at info@thebetteryu.com with your order number and supporting documentation, including photos of the item, packaging, shipping label, and any visible damage or discrepancy.
BetterYu may request additional information to evaluate the issue. Any resolution, including replacement, credit, partial adjustment, or other accommodation, will be provided at BetterYu’s sole discretion, except where otherwise required by law.
BetterYu does not guarantee replacement or refund for damaged or incorrect orders if:
- The issue is reported more than 48 hours after confirmed delivery;
- Supporting documentation is not provided;
- The item was lost, stolen, discarded, altered, opened, used, mishandled, stored improperly, or otherwise compromised after delivery;
- The shipping address provided was inaccurate or incomplete;
- The package was delivered to the address provided at checkout;
- The issue resulted from carrier delay, carrier handling, weather, theft, access issues, or other circumstances outside BetterYu’s control.
18. Shipping Disclaimer
Shipping timelines are estimates only and are not guaranteed. Delays may occur due to intake review, provider review, missing information, payment issues, product availability, pharmacy processing, fulfillment timing, weather, carrier delays, legal requirements, address issues, or other circumstances.
BetterYu is not responsible for delays, loss, theft, damage, temperature exposure, access issues, misdelivery, or other issues occurring after an order has been transferred to the shipping carrier or marked as delivered, except as required by law or expressly stated in writing.
You are responsible for providing an accurate shipping address and for promptly retrieving shipped items. BetterYu is not responsible for packages delivered to an incorrect address if the address was provided by you or entered incorrectly during checkout.
You agree to review and follow all storage, handling, and use instructions provided by BetterYu, the provider, the pharmacy, the product label, or accompanying materials.
19. Chargebacks and Payment Disputes
You agree to contact BetterYu directly at info@thebetteryu.com or 855-814-2626 to attempt to resolve any issue before initiating a chargeback, payment dispute, reversal, or similar action with your bank, card issuer, payment provider, or financial institution.
Unauthorized, improper, or bad-faith chargebacks may result in account restrictions, suspension of services, cancellation of pending orders, denial of future purchases, referral to collections, or other action available to BetterYu.
BetterYu reserves the right to submit documentation to payment processors, banks, card issuers, or dispute resolution platforms to contest chargebacks or payment disputes.
20. Communications Consent
By submitting your contact information, you authorize BetterYu, affiliated providers, patient portal platforms, pharmacies, payment processors, fulfillment partners, shipping carriers, and service partners to contact you regarding your inquiry, intake, account, care coordination, orders, payment, products, refills, shipping, follow-up, and related services.
Communications may occur by email, phone, text message, patient portal message, automated message, or other electronic means. Message and data rates may apply.
You understand that standard email and text messaging may not always be secure. You may request alternative communication methods where available.
You may opt out of promotional communications, but you may still receive transactional, legal, billing, safety, account-related, order-related, or service-related communications.
21. Privacy and Health Information
Your use of the website and submission of information may involve personal information and health-related information. BetterYu’s collection, use, and disclosure of information are described in our Privacy Policy and, where applicable, any additional privacy notices or consent documents.
If there is a conflict between these Terms and an applicable privacy notice regarding protected or regulated information, the applicable privacy notice will control to the extent required by law.
22. Website Use Rules
You agree not to misuse the website or related services. Prohibited conduct includes, without limitation:
- Using the website for unlawful, fraudulent, harmful, or abusive purposes;
- Submitting false, inaccurate, misleading, or incomplete information;
- Impersonating another person;
- Attempting to access accounts, systems, data, or portals without authorization;
- Interfering with website security or functionality;
- Uploading or transmitting viruses, malware, or harmful code;
- Scraping, copying, harvesting, or extracting website content or data without permission;
- Using the website to harass, threaten, defame, or harm others;
- Misusing, transferring, reselling, or redistributing prescription products;
- Attempting to obtain products or services through deception, omission, or falsified information;
- Violating applicable federal, state, or local law.
BetterYu may restrict, suspend, or terminate access to the website, services, account, checkout, intake, or related offerings if we believe these Terms have been violated.
23. Intellectual Property
The BetterYu website and its content, including text, graphics, logos, icons, images, videos, designs, service descriptions, page layouts, forms, educational materials, and other materials, are owned by or licensed to BetterYu and are protected by intellectual property laws.
You may view website content for personal, non-commercial use only. You may not copy, reproduce, modify, distribute, sell, exploit, or create derivative works from website content without prior written permission from BetterYu.
The BetterYu name, logo, branding, and related marks may not be used without written authorization.
24. User Submissions
If you submit information, messages, forms, reviews, testimonials, images, comments, or other content to BetterYu, you represent that the information is accurate and that you have the right to submit it.
You grant BetterYu the right to use submitted information as necessary to provide services, operate the website, process requests, coordinate orders, communicate with you, comply with legal obligations, and otherwise as described in our Privacy Policy or applicable consent forms.
BetterYu is not required to display, publish, or retain user-submitted content and may remove content at any time.
25. Reviews, Testimonials, and Marketing Content
If you provide a review, testimonial, photo, video, feedback, or other content for marketing purposes, BetterYu may use it only as permitted by applicable law and any consent or authorization you provide.
Testimonials represent individual experiences and are not guarantees of results.
26. Third-Party Links
The website may contain links to third-party websites, portals, payment pages, social media platforms, pharmacy pages, scheduling tools, or other resources.
Third-party links are provided for convenience only. BetterYu does not control and is not responsible for third-party websites, content, privacy practices, terms, security, accuracy, or availability.
Accessing third-party links is at your own risk.
27. Website Availability and Accuracy
BetterYu makes reasonable efforts to maintain accurate and current website information, but we do not guarantee that website content is complete, accurate, current, uninterrupted, secure, or error-free.
Website content, products, services, pricing, availability, providers, pharmacy options, program details, and policies may change at any time without notice.
BetterYu may update, suspend, modify, or discontinue any part of the website, products, or services at any time.
28. Disclaimer of Warranties
To the fullest extent permitted by law, the BetterYu website and related online services are provided on an “as is” and “as available” basis.
BetterYu disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, security, and uninterrupted operation.
BetterYu does not warrant that the website will be error-free, secure, uninterrupted, free of harmful components, or that any defects will be corrected.
Some jurisdictions do not allow certain warranty exclusions, so some exclusions may not apply to you.
29. Limitation of Liability
To the fullest extent permitted by law, BetterYu and its owners, officers, directors, employees, contractors, affiliates, service providers, licensors, and agents will not be liable for any indirect, incidental, consequential, special, exemplary, punitive, or enhanced damages, including lost profits, lost revenue, lost data, loss of goodwill, service interruptions, or business losses, arising from or related to your use of the website, products, services, or these Terms.
To the fullest extent permitted by law, BetterYu’s total liability for claims arising from or related to the website, products, services, or these Terms will not exceed the amount you paid directly to BetterYu for the product or service giving rise to the claim during the three months preceding the event giving rise to the claim, or $100, whichever is greater.
Nothing in these Terms limits liability that cannot legally be limited, including liability for gross negligence, willful misconduct, or rights that cannot be waived under applicable law.
30. Indemnification
You agree to defend, indemnify, and hold harmless BetterYu and its owners, officers, directors, employees, contractors, affiliates, service providers, licensors, and agents from and against any claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys’ fees, arising from or related to:
- Your use or misuse of the website, products, or services;
- Your violation of these Terms;
- Your submission of inaccurate, incomplete, false, or misleading information;
- Your violation of applicable law;
- Your misuse, transfer, resale, or unauthorized use of products;
- Your violation of another person’s rights;
- Your chargeback, payment dispute, or payment reversal made in violation of these Terms.
31. Dispute Resolution
Please review this section carefully. It may affect your legal rights.
Before filing a formal claim, you agree to first contact BetterYu at info@thebetteryu.com or 855-814-2626 and attempt to resolve the dispute informally. BetterYu will make reasonable efforts to respond and attempt to resolve the dispute.
To the extent permitted by law, any dispute, claim, or controversy arising out of or relating to these Terms, the website, BetterYu products, or BetterYu services shall be resolved through binding arbitration on an individual basis, rather than in court, except that either party may bring an individual claim in small claims court where permitted.
The arbitration shall be administered by a mutually agreed arbitration provider, or if the parties cannot agree, by the American Arbitration Association under its applicable consumer arbitration rules.
You and BetterYu agree that claims may be brought only in an individual capacity and not as a plaintiff, class member, or representative in any class, collective, consolidated, private attorney general, or representative action.
This arbitration section does not prevent you from filing complaints with government agencies or exercising rights that cannot be waived under applicable law.
32. Governing Law
These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law principles, except where another jurisdiction’s law is required to apply.
If any dispute is not subject to arbitration, the parties agree to submit to the state or federal courts with appropriate jurisdiction, unless applicable law requires otherwise.
33. State-Specific Rights and Service Availability
Some states provide consumers, patients, or website users with additional rights that cannot be waived by contract. Nothing in these Terms is intended to limit rights that cannot legally be limited.
Consultation format, provider evaluation method, prescribing eligibility, refill authorization, and service availability may vary by state and will be determined before consultation based on applicable law and provider requirements.
Availability of products and services may vary by state. BetterYu may decline to provide products or services in jurisdictions where they are not available, not permitted, or otherwise inappropriate.
34. Changes to These Terms
BetterYu may update these Terms from time to time. The updated version will be posted on this page with a revised “Last Updated” date.
Your continued use of the website after updated Terms are posted means you accept the updated Terms, except where additional notice or consent is required by law.
35. Severability
If any provision of these Terms is found to be invalid, unlawful, or unenforceable, the remaining provisions will remain in full force and effect.
Any invalid or unenforceable provision will be interpreted to achieve its intended purpose to the greatest extent permitted by law.
36. Entire Agreement
These Terms, together with any applicable Privacy Policy, telehealth consent, informed consent, payment terms, patient portal terms, pharmacy disclosures, order terms, and other written agreements or consents, constitute the agreement between you and BetterYu regarding use of the website, products, services, and related online offerings.
