PLEASE READ CAREFULLY. BY CLICKING “I AGREE,” CHECKING A BOX, CREATING AN ACCOUNT, OR OTHERWISE ACCESSING OR USING THE BETTER YU WEBSITE, MOBILE APPLICATION(S), TELEHEALTH PLATFORM, OR PRODUCTS (COLLECTIVELY, THE “SERVICE”), YOU AGREE TO BE BOUND BY THESE TERMS & CONDITIONS (THIS “AGREEMENT”). IF YOU DO NOT AGREE, DO NOT USE THE SERVICE.
1. Parties, Scope, Definitions
1.1 Parties. This Agreement is between you (“you,” “User”) and Better Yu, LLC, a Wyoming limited liability company (referred to as “Better Yu”, “we”, “us”, or “our”).
1.2 Scope. These Terms govern your access to and use of the Service, including (without limitation) Better Yu’s website(s), mobile app(s), e-commerce store (peptide pens and supplies), telehealth consultations, subscription programs, educational materials, customer support and any content or functionality offered via the Service.
1.3 Definitions. Capitalized terms used but not otherwise defined in this Agreement have the meanings set forth below:
- “Content” means all text, graphics, logos, images, audio, video, downloads, product descriptions, blog posts and other materials provided via the Service.
- “Products” means goods offered for sale through the Service, including auto-injection devices, pre-filled peptide pens, needles/supplies, cold packs, and ancillary items.
- “Providers” means licensed medical professionals (physicians, nurse practitioners, physician assistants, or other clinicians) who may provide telehealth evaluations or prescribe medications.
- “Third-Party Providers” means third-party pharmacies, fulfillment centers, laboratories, payment processors, and other vendors.
- “PHI” means protected health information as defined under HIPAA where applicable.
- “Subscriptions” means recurring purchase plans for Products and certain Services that auto-renew until cancelled.
2. Acceptance; Updates; Consent
2.1 By using the Service you accept and agree to be bound by this Agreement in full.
2.2 We may modify these Terms at any time by posting updated terms with a new “Last updated” date. Continued use after posting constitutes acceptance of the revised Terms.
2.3 You consent to electronic communications and to the use of electronic signatures in connection with the Service and this Agreement.
3. Eligibility; Account Registration; Account Security
3.1 You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service unless otherwise permitted by a specific program.
3.2 You agree to provide accurate, complete and current account information. You are responsible for maintaining confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately of unauthorized use. We may suspend or terminate accounts for inaccurate information or suspected misuse.
3.3 Multiple accounts, use of false identities, or any attempt to circumvent purchase limits, promotions or eligibility restrictions is prohibited.
4. Orders, Pricing, Payment, and Billing
4.1 Order Acceptance. Receipt of an order confirmation does not guarantee acceptance. We reserve the right to refuse or cancel orders for any lawful reason (including regulatory restrictions, stock availability, suspected fraud, or incomplete/incorrect billing/shipping information).
4.2 Pricing & Taxes. Prices are shown at checkout. Taxes, duties and shipping charges are added as applicable. You are responsible for all applicable taxes and import duties for cross-border shipments unless stated otherwise.
4.3 Payment Processing. Payments are processed by third-party payment processors (e.g., Stripe, Adyen). By providing payment information you authorize Better Yu and our processors to charge the payment method for purchases, recurring fees, taxes, shipping, and applicable penalties. We may update your stored payment method with card network updates (if provided by your issuer).
4.4 Subscription Billing. Subscriptions auto-renew at the cadence and price shown at purchase. You may cancel subscriptions via your account or by contacting Customer Support. Cancellations take effect at the end of the then-current billing period. Refunds for partial billing periods are not guaranteed except as required by law or at our discretion.
4.5 Refunds & Chargebacks. Unauthorized chargebacks or disputes may result in account suspension. If you believe a charge is erroneous, contact Customer Support to resolve it before initiating a chargeback.
5. Prescription Products, Telehealth, Pharmacies & Labs
5.1 Clinical Evaluations & Prescriptions. Certain Products require a prescription. A prescription will be issued only if a Provider determines it is clinically appropriate following a telehealth consultation and review of your medical information. Better Yu does not guarantee that a Provider will prescribe any Product.
5.2 Provider Relationship. Providers who deliver telehealth services are independent contractors, not employees, agents or representatives of Better Yu. The Provider is solely responsible for medical decisions and clinical care. Use of the Service does not create a physician-patient relationship with Better Yu; you may form such a relationship with the Provider once the Provider accepts you as a patient.
5.3 Pharmacy Fulfillment. If prescribed, prescription Products may be filled by affiliated or partner pharmacies or by a pharmacy you select. Prescriptions may be transferred among participating pharmacies as necessary for fulfillment. You acknowledge that some pharmacies may be located outside your state; we will comply with applicable law governing cross-state pharmacy practice and shipping.
5.4 Laboratory Services. Any lab testing ordered through the Service will be performed by third-party laboratories. Results and interpretation are the responsibility of the ordering Provider and the lab.
5.5 Regulatory Limitations. Availability of telehealth services, prescriptions, and Products may be limited by state/provincial law. By using the Service you represent that you are located where the Service and any requested Product are lawful.
5.6 State Consumer Notices.
5.6.1 California Residents — Important Consumer Notice (CCPA / CPRA / Automatic Renewal / ARL). You have rights under California privacy laws, including the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA). If Better Yu “sells” or “shares” personal information, we will provide a clear and conspicuous “Do Not Sell or Share My Personal Information” link on our homepage and on pages that collect personal data. You may submit an opt-out request without creating an account. If you enroll in any subscription or automatic-renewal service, you will receive clear and conspicuous disclosures of the material terms before you contract, and we will obtain your express affirmative consent prior to charging you for any automatic renewal. We will provide an easy online cancellation mechanism and a post-transaction acknowledgement (receipt) summarizing renewal terms. How to exercise rights (California). Email info@thebetteryu.com or use the Do-Not-Sell/Share link on our site. We may require reasonable verification to process requests in a manner consistent with applicable law.
5.6.2 New York Residents — Subscription & Automatic Renewal Notice. New York law requires that automatic renewal offers include clear and conspicuous disclosures of material terms (including price, renewal period, and cancellation policy) before the consumer’s purchase and in the post-transaction acknowledgement. Better Yu will provide these disclosures at checkout and in the confirmation email. If you enrolled online, you will be provided an easy method to cancel online. How to cancel (New York). Cancel via your account dashboard or by contacting Customer Support at info@thebetteryu.com. We will confirm cancellation by email.
5.6.3 Texas Residents — Subscription & Automatic Renewal Notice. Texas requires businesses to disclose renewal terms, provide the procedure for cancellation, and in some cases send advance notice for long-term (12+ month) agreements. Better Yu provides conspicuous pre-purchase disclosure of renewal terms, a simple cancellation mechanism, and renewal reminders where required by applicable state law. How to cancel (Texas). Cancel online, via email to info@thebetteryu.com, or by phone. Cancellation will be effective as described in our Subscription Terms.
5.6.4 Florida Residents — Automatic Renewal & Cancellation Notice. Florida requires sellers of service contracts that auto-renew (typically contracts of twelve (12) months or longer) to provide written or electronic notification and to permit cancellation by the same method the consumer used to accept the contract. Better Yu provides a conspicuous disclosure at purchase, a cancellation method equivalent to the sign-up method, and advance notice where required by statute. How to cancel (Florida). Use the online cancel option, email info@thebetteryu.com, or call Customer Support; cancellation will follow the same channel used to enroll.
5.6.5 General. These State Consumer Notices are provided for informational purposes only and do not limit any other rights you may have under applicable law. For full information about how we collect, use, share and protect your personal information, please see our Privacy Policy and the Do-Not-Sell/Share page linked on our site.
6. Telehealth Consent & Patient Acknowledgment
6.1 Before any telehealth consult, you must review and electronically sign the telehealth informed consent that explains telehealth benefits and limitations, privacy risks, emergency protocols, and state licensing limitations.
6.2 Telehealth limitations include (but are not limited to): inability to physically examine you, reliance on your self-reported history, potential technological interruptions, and inability to treat certain conditions remotely. Providers may recommend in-person care when necessary.
6.3 If you are seeking care for a minor, follow the parental/guardian consent process and only submit information you are authorized to share.
6. Telehealth Consent & Patient Acknowledgment

7. Product Use, Safety, Storage, and Disposal
7.1 Instruction Compliance. Follow Provider directions, product labeling, and training materials carefully. Misuse (incorrect dosing, sharing devices, failing to store as directed) can cause serious harm.
7.2 Device Training. For auto-injection devices we provide instructions and training videos; complete training before use. If you change a medication or concentration, contact a Provider for guidance.
7.3 Storage & Shipping Cold Chain. Some Products require refrigeration or temperature control. We ship per standard cold-chain practices where required, but extended transit or improper receipt may affect product integrity. If you suspect temperature excursion, do not use and contact Customer Support.
7.4 Sharps Disposal. Dispose of needles and sharps in approved sharps containers in compliance with local law. Better Yu is not responsible for improper disposal.
7.5 Allergies & Contraindications. Inform Providers of allergies, pregnancy, breastfeeding, or medical conditions. Do not use Products contrary to Provider instructions.
8. Shipping, Delivery, Returns & Recalls
8.1 Shipment & Risk. Shipping timelines are estimates only. Risk of loss passes to you when goods are delivered to the carrier.
8.2 Returns. For safety and regulatory reasons, prescription and certain perishable Products are generally non-returnable and non-refundable. Non-prescription items may be returned within the policy timeframe if unopened and in original packaging. See our Shipping & Returns page for details.
8.3 Defective Product & Recall. If you receive damaged or defective Product, notify Customer Support within [X] days. For safety recalls, Better Yu will attempt to notify affected customers with instructions for returns/disposal and remediation. You agree to cooperate in recalls or investigations.
8.4 Refused/Undeliverable Shipments. If shipment is refused, returned, or undeliverable for reasons outside our control, you remain responsible for shipping/return costs and any customs/taxes. We may charge restocking fees for returned orders where permitted.
9. Promotions, Discounts & Referral Programs
9.1 Promotions are subject to eligibility limits, can change or end without notice, void where prohibited, and cannot be combined unless stated. Referral credits, discounts or promotional credits expire per the program terms; non-transferable.
10. User Content; Reviews; License
10.1 Users may submit comments, reviews, questions, photos or other content (“Submissions”). You warrant you own or have rights to the Submission.
10.2 Except for Protected Health Information subject to law, by posting a Submission you grant Better Yu a perpetual, irrevocable, worldwide, royalty-free, transferable, sublicensable license to use, reproduce, modify, publish, translate, distribute, and display the Submission in connection with the Service and Better Yu’s business. You waive moral rights to the extent permitted by law.
10.3 We may remove, edit or refuse any Submission at our discretion.
11. Privacy, Data Use, HIPAA Business Associate Considerations
11.1 Privacy Policy. Our Privacy Policy (linked on the Site) explains how we collect, use and share data. You agree to that policy.
11.2 PHI & HIPAA. Better Yu is not necessarily a HIPAA covered entity. Certain Providers, Pharmacies and Labs may be covered entities. Where Better Yu acts as a HIPAA business associate regarding PHI that we handle on behalf of a covered entity, we will comply with applicable business associate obligations. If you have questions about privacy of medical data, consult the Privacy Policy and Provider notices.
11.3 Marketing Communications. By creating an account you may be opted into certain marketing communications; you may opt out any time via the unsubscribe link or account settings, subject to transactional messages which we may still send.
12. Intellectual Property
12.1 Better Yu and/or its licensors own all rights, title and interest in the Service and Content. No license is granted except as expressly set forth.
12.2 The Better Yu name and logos are trademarks; you may not use them without prior written permission.
13. Prohibited Conduct; Account Termination
13.1 You agree not to: (a) use the Service for unlawful purposes; (b) access the Service by automated or non-human means; (c) attempt to interfere with or compromise the Service security; (d) post false, misleading or defamatory Submissions; (e) misrepresent age, identity or insurance status; (f) share prescriptions, medications, or devices; (g) reverse engineer the Service; or (h) circumvent limitations or rate limits.
13.2 Violation may result in account suspension, denial of service, and legal action.
14. Monitoring; Enforcement; Lawful Requests
14.1 We reserve the right to monitor use, investigate and remove content that violates this Agreement or law. We may cooperate with law enforcement and third-party rights owners as required.
14.2 We will comply with lawful requests for information and may disclose account data consistent with the Privacy Policy and applicable law.
15. Third-Party Goods, Services & Links
15.1 The Service may include links to third parties. We do not control, endorse or guarantee third-party offerings. Your transactions with third parties are solely between you and that third party.
15.2 Better Yu is not liable for third-party acts or omissions, including errors, service levels, or privacy practices.
16. Representations & Warranties by You
You represent and warrant that: (a) you have legal capacity to agree to these Terms; (b) all info you provide is truthful, accurate and complete; (c) you will comply with any Provider instructions and with applicable law; and (d) you will not share prescriptions or Products with others.
17. Disclaimers; No Medical Advice; No Guarantees
17.1 The Service is provided AS IS and AS AVAILABLE. To the extent permitted by law we disclaim all warranties, express or implied (merchantability, fitness for a particular purpose, non-infringement).
17.2 The Content on the Service is for informational purposes only and not a substitute for professional medical advice. Always consult a Provider for diagnosis and treatment.
18. Limitation of Liability
18.1 TO THE MAXIMUM EXTENT PERMITTED BY LAW, BETTER YU’S TOTAL AGGREGATE LIABILITY ARISING FROM OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO BETTER YU FOR THE APPLICABLE PRODUCTS/SERVICES IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE THOUSAND U.S. DOLLARS (US $1,000).
18.2 IN NO EVENT SHALL BETTER YU BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOSS OF GOODWILL, OR LOSS OF DATA, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
18.3 SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS ON CERTAIN DAMAGES; WHERE PROHIBITED, SUCH LIMITATIONS WILL NOT APPLY.
19. Indemnification
You agree to indemnify, defend and hold harmless Better Yu, its officers, directors, employees, agents, affiliates, and licensors from and against any liabilities, losses, claims, damages and expenses (including attorneys’ fees) arising from: (a) your breach of these Terms; (b) your misuse of Products; (c) your Submissions or conduct; or (d) your violation of law.
20. Product Recalls; Safety Notifications
20.1 Better Yu maintains procedures to notify customers and regulatory authorities of product recalls or safety issues. If a recall is issued, you must follow the recall notice instructions. Failure to comply with recall instructions may create risk and legal exposure.
20.2 Better Yu may, at its discretion, provide replacement, refund or other remedy consistent with applicable law.
21. Export Controls; International Use
21.1 Products may be subject to U.S. or foreign export controls. You represent you will comply with all export/import laws and that Products will not be used, re-exported or transferred contrary to law.
21.2 If you access the Service outside the U.S., you do so at your own initiative and are responsible for compliance with local law. Availability of Products and services may be restricted by jurisdiction.
22. Electronic Communications; Notices
22.1 Notices to you may be provided via email, SMS, in-app messaging or posted on the Site. Notices to Better Yu should be sent to info@thebetteryu.com or to the physical address below. Electronic notices are effective when sent.
23. Arbitration; Class Action Waiver; Opt-Out
READ THIS SECTION CAREFULLY; IT LIMITS YOUR RIGHTS.
23.1 Arbitration Agreement. Except as set forth below, you and Better Yu agree that any dispute, claim, or controversy arising from or relating to these Terms, the Service, or your relationship with Better Yu will be resolved by confidential, binding arbitration, and not by court action, except that you may assert individual claims in small claims court if permitted. This arbitration agreement applies to Better Yu and our affiliates, agents, employees, successors and assigns.
23.2 Arbitration Forum and Rules. Arbitration will be administered by the National Arbitration & Mediation (“NAM”), American Arbitration Association (“AAA”) or JAMS (at Better Yu’s election) under the administering organization’s commercial rules in effect at the time the arbitration is initiated. The arbitrator will be bound by these Terms and shall apply the law of the State of Wyoming to substantive issues (except as otherwise required by applicable law). The arbitrator’s award may be confirmed by any court of competent jurisdiction.
23.3 Individual Claims Only. Arbitration will proceed on an individual basis; class, consolidation, representative or collective actions are not permitted unless both parties expressly agree in writing. The arbitrator may award the same relief that a court could award on an individual basis.
23.4 Exceptions. Either party may seek injunctive relief in a court of competent jurisdiction for intellectual property infringement or other equitable relief where arbitration would be inadequate. Disputes below the jurisdictional limit of small claims courts may be brought in such courts.
23.5 Opt-Out Right. If you do not wish to be bound by the arbitration agreement, you may opt out by sending a signed written notice within thirty (30) days of first becoming subject to these

The opt-out must include your name, address, email, and a statement that you opt out of arbitration under these Terms. Opt-out notices sent by agents or third parties will not be effective. If you validly opt out, the remainder of these Terms will remain in effect.
24. Governing Law; Venue; Severability
24.1 These Terms are governed by the laws of the State of Wyoming without regard to conflict of law rules.
24.2 Except as to matters required to be arbitrated or as otherwise specified, the state and federal courts located in Cheyenne, Wyoming have exclusive jurisdiction over actions not subject to arbitration.
24.3 If any provision is invalid or unenforceable under applicable law, it will be modified to the minimum extent necessary to make it enforceable and the remaining provisions remain in effect.
25. Force Majeure
Better Yu will not be responsible for delays or failures resulting from causes beyond its reasonable control, including acts of God, governmental acts, telecommunications failures, pandemics, labor disputes, shipping carrier delays, and supply chain interruptions.
26. Assignment
You may not assign or transfer this Agreement or your rights without prior written consent. Better Yu may assign or transfer these Terms, including in connection with a merger, acquisition, or sale of assets.
27. Survival
Sections that by their nature should survive termination (including Intellectual Property, Payment Obligations, Disclaimers, Limitations of Liability, Indemnification, Arbitration, Governing Law, and Privacy/Protected Information) will survive account termination or expiration of these Terms.
28. Entire Agreement, Amendments, No Waiver
These Terms (and the policies referenced herein) constitute the entire agreement between you and Better Yu regarding the Service. Failure to enforce any provision does not waive the right to enforce it later.

30. Additional Consumer Disclosures (Quick Reference)
- Medical Emergencies: Call 911 — do not rely on online services for emergencies.
- Refunds & Returns: Prescription/perishable items generally non-returnable. See Shipping & Returns for details.
- Data & Privacy: Privacy Policy governs data use; we may share PHI with providers/pharmacies per law.
- Arbitration Opt-Out: 30 days from first acceptance; send signed opt-out to info@thebetteryu.com.
- Cookies & Tracking: Our cookie policy is available on the Site.
8. Children’s Privacy
Our Services are not directed to children under 18. We do not knowingly collect personal data from minors. If you believe we have inadvertently collected data from a minor, please contact us to have it removed.
9. International Transfers
Your data may be stored or processed in the United States. If you reside outside the U.S., by using our Services, you consent to the transfer of your personal data to the U.S. in accordance with this Agreement.
10. Changes to This Agreement
We may update this Agreement to reflect changes in our practices or legal requirements. We will post the revised date at the top and notify you of significant changes via email or Site notice. Continued use after changes constitutes acceptance.
